Terms of Service

Welcome to Sunshine Stories. These Terms of Service ("Terms") are a legal agreement between you and Sunshine Stories ("we," "us," or "our"), the company that operates the Sunshine Stories mobile application and related services (together, the "Service"). Sunshine Stories uses artificial intelligence to help you create personalized, illustrated children's books. Please read these Terms carefully — they explain what you can expect from us and what we expect from you. Our Privacy Policy explains how we handle personal information, and our AI Transparency Notice provides more information about our use of artificial intelligence.

1. Acceptance of These Terms

By creating an account, downloading or installing the app, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with these Terms, please do not use the Service.

The AI Transparency Notice provides additional information for clarity and does not replace or modify these Terms or the Privacy Policy.

If you are using the Service on behalf of another person or an organization, you confirm that you have the authority to accept these Terms on their behalf, and "you" refers to that person or organization.

2. Eligibility

The Service is intended for adults. You must be at least 18 years old and a parent, legal guardian, or other adult to create an account and use the Service. Sunshine Stories is a general-audience, parent-facing product. It is not directed to children, and children do not create accounts or use the app directly.

The books you create are made for children to enjoy, but the account holder and user of the app is always an adult. You are responsible for deciding what content is appropriate to share with any child in your care, and for supervising any child who reads or listens to a book you create.

By using the Service, you represent that you meet these eligibility requirements and that the information you provide to us is accurate.

3. Your Account

To use most features, you'll create an account using your name, email address, optional phone number, and a password. You are responsible for:

• Providing accurate and current account information.
• Keeping your password confidential and your account secure.
• All activity that happens under your account.

Please let us know promptly if you believe your account has been accessed without your permission. We are not responsible for losses caused by someone using your account with or without your knowledge if you have not kept your credentials secure.

4. Description of the Service

Sunshine Stories lets you create personalized, illustrated children's books using materials you choose to provide. Some content is generated using artificial intelligence. You can review, edit, and read your books in the app.

We may add, change, or remove features over time, and we may set or adjust reasonable limits on how the Service is used. We'll try to give you notice of significant changes when we reasonably can, but we are not obligated to maintain any particular feature.

5. Subscriptions, Billing, and Auto-Renewal

Some features of the Service require a paid subscription that grants you a recurring allowance of books or other entitlements.

Billing through the app stores. Subscriptions are sold and billed as in-app purchases through the Apple App Store or Google Play. Apple or Google processes your payment under its own terms. Sunshine Stories does not receive or store your payment card details. We receive and retain subscription and purchase records used to manage access. Our Privacy Policy explains how we handle this information.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price, and your store account will be charged for the renewal, unless you cancel at least 24 hours before the end of the current period (or within the window required by the app store). Prices may change; where required, we or the app store will give you notice and the opportunity to cancel before a price change takes effect.

Managing and cancelling. You manage, change, or cancel your subscription through your Apple App Store or Google Play account settings — not directly within Sunshine Stories. Cancelling stops future renewals. Your paid entitlements generally remain available until the end of the period you've already paid for.

Refunds. Because purchases are processed by Apple or Google, refunds are handled according to the app store's policies. Any refund requests must usually be made through the relevant app store. Except where required by law, payments are non-refundable, and your monthly book allowance or other entitlements do not roll over or refund if unused, and are not refunded if a particular generation does not produce a result you like.

Apple EULA. If you use the Service on an Apple device, your license to use the app is also governed by Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, except to the extent these Terms grant you broader rights. The Apple-specific terms in Section 16 also apply.

6. Your Content and Uploads

"Your Content" means materials you provide to the Service and content generated for you based on those materials.

Your responsibilities. You must have all rights and permissions needed to upload and use Your Content. In particular, you confirm that:

• You own or have permission to upload each photo and any other material you provide.
• You have the right to use the likeness, name, and image of any child, person, or pet depicted in a photo you upload, and you have obtained consent from any other parent or guardian where that is required.
• Your Content does not infringe anyone's rights or violate any law.

License you grant us. So that we can operate the Service for you, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, adapt, and display Your Content, and to permit our service providers to do the same, solely to provide, secure, maintain, moderate, and improve the Service for you. This license exists only to run the Service; it does not transfer ownership of Your Content to us. The license ends when Your Content is deleted from our systems, except for copies retained for safety, audit, backup, or legal reasons as described in Section 11 and our Privacy Policy, and except for any content already shared in line with your use of the Service.

You are responsible for keeping your own copies of finished books that matter to you. While we aim to keep the Service reliable, we do not guarantee that Your Content will always be available or recoverable.

7. Acceptable Use

We want Sunshine Stories to be a safe, warm place to make something for the children in your life. To keep it that way, you agree that you will not:

• Upload a photo of, or otherwise depict, another person (including another person's child) without the consent of that person or their parent or guardian.
• Upload or request content that is unlawful, harmful, abusive, harassing, hateful, sexually explicit, that sexualizes or endangers a minor, or that depicts or encourages violence or exploitation.
• Use the Service to create content that infringes intellectual property, privacy, or publicity rights, or that is defamatory or deceptive.
• Attempt to bypass, disable, or interfere with our safety, moderation, content-filtering, rate-limiting, or security measures, or probe the Service for vulnerabilities.
• Reverse engineer, decompile, or attempt to extract source code from the Service, except where the law expressly permits it.
• Use automated means to access the Service in a way that places an unreasonable load on it, scrape it, or resell or commercially redistribute access to it.
• Use the Service to violate any applicable law or the rights of others, or in any way not permitted by these Terms.

We may apply automated and human review to enforce these rules. We may remove content, limit functionality, or suspend or terminate accounts that violate this section or that present a safety or legal risk.

8. AI-Generated Content: Important Disclosure and Disclaimer

Sunshine Stories uses artificial intelligence to generate some content provided through the Service. Our AI Transparency Notice provides more information about that use, and our Privacy Policy explains how we handle the materials you provide.

AI output may be inaccurate or unexpected. AI-generated content may be inaccurate, incomplete, inconsistent, stylized, surprising, or simply not what you expected. It may not faithfully or accurately depict any real person, child, pet, place, or event. Repeated requests may produce different results.

For personal, creative, entertainment use only. Books and other content created with Sunshine Stories are intended for personal, creative, and entertainment purposes. They are works of imagination. They are not, and must not be relied on as, professional, medical, psychological, educational, legal, or other expert advice. Do not use AI-generated content as a substitute for advice from a qualified professional.

Please review before sharing with a child. You are the adult in charge. Always review a book — its words and its pictures — before reading it to or sharing it with a child. You know your child and your family; you decide what is appropriate. We strongly encourage you to preview generated content yourself first.

Safeguards are not guaranteed to be perfect. We use safeguards intended to reduce unsafe or inappropriate content. They may miss some content and may also flag or block content that is appropriate. We do not warrant that every output will be safe, accurate, appropriate, or free of error, and the responsibility to review content before sharing it with a child remains with you.

No reliance. To the fullest extent permitted by law, you agree that you use AI-generated content at your own discretion and risk, and that we are not liable for any decision you make or action you take in reliance on it.

9. Intellectual Property

Our rights. The Service itself — including the Sunshine Stories app, its software, design, branding, name, logos, proprietary technology, and all related materials we provide — is owned by us or our licensors and is protected by intellectual property and other laws. Except for the rights expressly granted in these Terms, we reserve all rights in the Service. You may not use our names, logos, or branding without our prior written permission.

Your books. As between you and us, and subject to applicable law and third-party rights, we do not claim ownership of the finished books you generate. We grant you the right to use, store, print, and share the books you create with Sunshine Stories for your own personal, non-commercial family use. The ability to assert ownership or exclusive rights in AI-generated output can be limited or unavailable under the laws of some places; we make no promise that any particular book or element of it is protectable by copyright or is free of others' rights. You are responsible for how you use and share the books you create.

Feedback. If you send us ideas, suggestions, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose without obligation to you.

10. Third-Party Services

The Service depends on third-party services to operate. Your use of some third-party services may be subject to their own terms and policies. We are not responsible for the acts, omissions, content, policies, or availability of third parties. Our Privacy Policy explains how information may be shared with service providers.

11. Termination and Account Deletion

Your right to stop and delete. You may stop using the Service at any time. You can delete your account from within the app. When you start account deletion, a 30-day removal window begins. During those 30 days, you can restore your account by signing back in. After the 30-day window passes, your account and its stories are permanently removed from active use, subject to the limited retention described below.

Retention after deletion. When you delete content, some data may be retained for a limited period for audit, safety, security, backup, and legal-compliance purposes. We describe our retention practices more fully in our Privacy Policy.

Suspension or termination by us. We may suspend or terminate your access to the Service, in whole or in part, if you violate these Terms, if we are required to by law, or if we reasonably believe it is necessary to protect the Service, other users, or any person — including for safety reasons. Where reasonable and lawful, we'll aim to give you notice.

Effect of termination. When your account is terminated, your right to use the Service ends. Sections of these Terms that by their nature should survive termination — including content licenses already exercised, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Service or the servers that make it available are free of harmful components; or that any content will be accurate, reliable, safe, appropriate, or meet your expectations.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, any mandatory warranties are limited to the minimum extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law:

• We, and our affiliates, officers, employees, agents, suppliers, and licensors, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service or any AI-generated content — even if we have been advised of the possibility of such damages.
• Our total liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service during the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (US$50).

These limitations apply regardless of the legal theory on which a claim is based. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you; in those places, our liability is limited to the maximum extent permitted by law.

14. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Sunshine Stories and our affiliates, officers, employees, agents, suppliers, and licensors from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content, including any photo or material you upload; (b) your use of the Service; (c) your violation of these Terms or of any law; or (d) your violation of the rights of any third party, including any person whose image, name, or likeness you upload without proper consent. We may, at our own expense, assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us.

15. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in the State of Tennessee will have exclusive jurisdiction and venue over any dispute that is not otherwise subject to a binding alternative process, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any mandatory consumer-protection rights you have under the laws of the place where you live.

16. Apple App Store Additional Terms

These additional terms apply if you download or use the app from the Apple App Store, and apply only to that use:

• These Terms are between you and Sunshine Stories only, not with Apple. Apple is not responsible for the Service or its content.
• Your license to use the app is a limited, non-transferable license to use it on Apple-branded devices you own or control, as permitted by the Usage Rules in Apple's App Store terms and the Apple Standard EULA.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims relating to the app are our responsibility, not Apple's.
• Apple is not responsible for addressing any claims you or a third party have relating to the app, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection or similar laws.
• In the event of a third-party claim that the app or your use of it infringes that party's intellectual property rights, Sunshine Stories, not Apple, is responsible for the investigation, defense, settlement, and discharge of such a claim, to the extent required by these Terms.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they apply to your use of the app from the Apple App Store, and upon your acceptance Apple will have the right to enforce these Terms against you as a third-party beneficiary.

17. Changes to These Terms

We may update these Terms from time to time — for example, to reflect changes to the Service, our providers, or the law. When we make material changes, we'll update the effective date and version shown at the top of this page and, where appropriate, give you notice in the app or by email. Changes take effect when posted unless we say otherwise. By continuing to use the Service after an update takes effect, you accept the updated Terms. If you do not agree, please stop using the Service and delete your account.

18. General

These Terms, together with our Privacy Policy and any store terms that apply, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest stays in effect, and the unenforceable part will be limited or removed to the smallest extent necessary. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets. These Terms do not create any agency, partnership, or joint venture between us.
